I use a chatbot or AI content towards customers: what must I do?
Tell the user they are talking to an AI system and label content that AI generated. Applies from 2 August 2026; for systems on the market before that date the deadline for labelling content is 2 December 2026 (Digital Omnibus on AI).
- Who must?
- Anyone who uses a chatbot, automatic replies or AI-generated images, video and text towards customers.
- What to do?
- Chatbot: say clearly that it is AI.
- AI images, video and audio: label them (machine-readable where possible).
- Check the tools you use: most already have labels, switch them on.
- Where to file?
- Nothing is filed; the labels live in the system and the content itself.
- Who checks?
- National AI supervisory authority
- Fine
-
We are checking the fine in the source; until then we do not write a number.
- What if I am already late?
- Add the labels now; for older systems the deadline for labelling content is 2 December 2026.
What gets said wrong online
Wrong: "The AI Act concerns only big companies."
Right: The transparency obligations (art. 50) apply to anyone who uses AI towards people, including a small salon with a chatbot.
Sort it out
The free solution comes first, then tools. Nobody calls you.
