Do I need a cookie banner?
If your website has Google Analytics, Meta Pixel or similar tools, yes: such cookies and scripts may load only after the visitor gives consent (clicks "Accept"), with a clear notice and an equally easy "Reject". Essential cookies (basket, login) need no consent. Without tracking tools you need no banner. Checked by the data protection authority (in Croatia AZOP; HAKOM for electronic communications). This card is being checked: the article of the Croatian Electronic Communications Act is being confirmed.
- Who must?
- Anyone whose website has analytics, ad pixels or embedded videos/maps that set cookies.
- What to do?
- List the scripts and cookies on the site (the Website radar shows the most common ones).
- Set up a banner that loads non-essential scripts only after consent, with an equally visible "Reject".
- Describe the cookies in the privacy notice: which, why, for how long.
- Where to file?
- Nothing is filed; consents are logged in the cookie tool.
- Who checks?
- Data protection authority (AZOP); HAKOM for electronic communications
- Fine
-
GDPR: up to 20 million € or 4 % of turnover (art. 83); the national electronic communications act sets its own fines.
We are confirming the amount in the source before we publish it.
- What if I am already late?
- First remove the tracking tools or make them conditional on consent; a banner that does not actually block scripts is worth nothing.
What gets said wrong online
Wrong: "Writing "by continuing you accept cookies" is enough."
Right: It is not: consent must be an active action, and the scripts must not load before it.
Sort it out
The free solution comes first, then tools. Nobody calls you.
- Regulation (EU) 2016/679 (GDPR), art. 4(11), 6 and 7, read on 25 Oct 2026
- Croatian Electronic Communications Act, NN 76/22 (the article on storing data on terminal equipment is being confirmed)
- Directive 2002/58/EC (ePrivacy), art. 5(3)
