When does a sole trader file the annual income tax return?

A trade taxed on actual income (not flat-rate) must file the annual income tax return (DOH) by the end of February for the previous year, through ePorezna. Contributions are paid monthly by the 15th for the previous month. Checked by the Tax Administration.

Who must?
Trades, freelancers and other self-employed persons who determine income from business books (art. 48(1)(1)). Not flat-rate trades (they file the PO-SD).
What to do?
  1. Close last year's books with your accountant.
  2. File the annual return (DOH form) in ePorezna by the end of February.
  3. Every month by the 15th: contributions for the previous month; advance tax per the Tax Administration decision.
Where to file?
ePorezna (DOH form); payments to the prescribed accounts.
Who checks?
Tax Administration (Porezna uprava)
Fine
Not filing a tax return in time: sole trader 260 to 26,540 € (General Tax Act art. 193(1)(9) and (2)). Not paying or underpaying the tax per the annual return: sole trader 660 to 6,630 € (Income Tax Act art. 92(1)(1)). Late contributions: 660 to 3,980 € (Contributions Act art. 252).
What if I am already late?
File now; otherwise the Tax Administration assesses the tax by estimate (art. 48(4)), which is usually more expensive.

What gets said wrong online

Wrong: "Only those with a profit file the return."

Right: A taxpayer with income from self-employment always files, even with a loss (art. 48(1)).
