What do I have to do when I hire my first employee?
A written employment contract (or a written confirmation before work starts), registration for pension and health insurance before the first day with a copy of the registration given to the worker, and records of workers and of working time from day one. The same for part-timers under an employment contract; students and service contracts follow other rules. Checked by the labour inspection (State Inspectorate).
- Who must?
- Every employer with at least one worker: a trade, a d.o.o., an association, a family farm.
- What to do?
- Sign a written employment contract with all the elements of art. 15 of the Labour Act before work starts.
- Register the worker with HZMO (e-Prijave) before the first day and give them a copy; health insurance follows automatically.
- From day one keep the records of workers and the daily working time records (Rulebook NN 73/17).
- Where to file?
- HZMO e-Prijave (registration); records stay with you, shown to the inspector on request.
- Who checks?
- State Inspectorate (labour inspection)
- Fine
-
The Labour Act prescribes fines for work without a written contract or confirmation and for not handing over the registration copy (art. 14), and for missing records (art. 5); we are confirming the amounts.
We are confirming the amount in the source before we publish it.
- What if I am already late?
- Do the registration and the contract now; unregistered work carries the highest fines.
What gets said wrong online
Wrong: "I can register within 8 days."
Right: Registration goes before work starts; the worker gets a copy within the deadlines of art. 14(5).
