Do I have to state the salary in a job ad?

By 7 June 2026 member states transpose the Pay Transparency Directive. From then on every employer must give applicants the initial pay or its range before the interview (in the ad or otherwise) and may not ask about pay at a previous employer. Employees have the right to information on average pay by category. Pay gap reporting: from 150 employees on 7 June 2027, from 100 employees on 7 June 2031.

Who must?
Every employer in the EU, whatever its size, for the rules on ads and interviews; reporting only from 100 employees.
What to do?
  1. Put the initial pay or its range in job ads or in the interview invitation.
  2. Remove the question about current or previous pay from forms and interviews.
  3. Prepare an answer to employees' requests about average pay by category (two-month deadline).
Where to file?
Nothing is filed (below 100 employees); larger employers submit the pay gap report.
Who checks?
The labour inspectorate and the equality body in each member state
Fine
A directive: each member state sets the penalty in its own law (for Croatia we follow the Official Gazette).
What if I am already late?
Add the salary range to your ads now; it is also the cheapest change.

What gets said wrong online

Wrong: "It only applies to companies with more than 100 employees."

Right: The 100 threshold is for reporting; the salary range in the ad and the ban on asking about previous pay apply to all employers.
