What do I have to show next to a product in my online shop?
Since 13 December 2024, every distance offer (online shop, marketplace) must show the manufacturer's name, address and e-mail (and the responsible person in the EU if the manufacturer is outside the EU), the product identification and safety warnings in the buyer's language. A product not covered by specific EU rules must be "safe" under the Regulation, and accidents are reported through the Safety Business Gateway.
- Who must?
- Anyone selling goods to consumers in the EU, online or in a shop; imports from third countries need a responsible person in the EU.
- What to do?
- Add the manufacturer (name, address, e-mail) to every product description online and, if outside the EU, the responsible person in the EU.
- Add the product identification (type, batch) and warnings in the language of the buyer's country.
- Decide who reports accidents and dangerous products through the Safety Business Gateway.
- Where to file?
- Accidents and dangerous products: Safety Business Gateway (art. 20); otherwise nothing.
- Who checks?
- The market surveillance authority (in Croatia: the State Inspectorate)
- Fine
- Penalties are set by each member state (art. 44); in Croatia the General Product Safety Act.
- What if I am already late?
- Complete the product descriptions online; it is the most common gap found by inspectors.
What gets said wrong online
Wrong: "Writing "importer" is enough."
Right: You need the manufacturer with address and e-mail, and for goods from outside the EU also a responsible person in the EU (art. 16 and 19).
Sort it out
The free solution comes first, then tools. Nobody calls you.
