From how many employees do I need work rules (pravilnik o radu)?
From at least 20 workers an employer in Croatia must adopt and publish work rules: pay, organisation of work, protection of workers' dignity, protection from discrimination and other matters, unless a collective agreement covers them. Below 20 it is not mandatory, but those matters must be settled in contracts. Checked by the labour inspection.
- Who must?
- Employers with 20 or more workers (this card shows from 10 workers, because the number changes fast).
- What to do?
- Count the workers under employment contracts (not freelancers under service contracts).
- At 20 or more: adopt the work rules, consult the works council if there is one, publish them.
- Below 20: settle pay, working time and dignity protection in contracts or decisions.
- Where to file?
- Nothing is filed; the rules are published to the workers.
- Who checks?
- State Inspectorate (labour inspection)
- Fine
-
The Labour Act prescribes a fine for an employer who does not adopt and publish work rules (art. 26(1)); we are confirming the amount.
We are confirming the amount in the source before we publish it.
- What if I am already late?
- Adapt a template to your business and publish it on the notice board or intranet.
What gets said wrong online
Wrong: "Every company needs work rules."
Right: The obligation starts at 20 workers; for smaller ones it is not mandatory, but useful.
